EPS regulations in the US

As the US moves to eliminate single-use EPS packaging to support a more circular economy - mirroring the movement seen in Europe - what began as isolated state initiatives has evolved into a coordinated national movement. It started with Washington, D.C. in 2016, which began tightening restrictions early. Maryland was the first state to implement a full ban in 2020, followed by Maine and Vermont in 2021. New Jersey and New York joined the effort in 2022. Colorado enacted its ban in January 2024, with Washington state following in June 2024.
 
Looking ahead, California, Delaware, Oregon, and Rhode Island are set to implement bans in 2025. Virginia is taking a phased approach: large businesses will need to comply by July 2025, while smaller businesses have until July 2026.
 
This regulatory momentum extends far beyond simple product bans. Extended Producer Responsibility (EPR) initiatives are gaining serious traction, with Minnesota becoming the fifth state to adopt EPR for packaging in 2024. California, Colorado, Maine, Minnesota, and Oregon now have EPR frameworks in place, with Oregon's programme launching in July 2025.
 
The recycled content requirements are equally compelling. California mandates 30% recycled content in all plastic packaging by 2028, rising to 40% by 2030. Washington state has already begun issuing fines for non-compliance with its recycled content laws, while New Jersey is ramping up requirements across multiple packaging categories.
